Privacy Notice describes how ART19 LLC and its subsidiaries (collectively,
“ART19”), collect and process your personal information through ART19’s
website and related subdomains and the podcast services that reference this
Privacy Notice (together "ART19 Services"). By using ART19 Services, you are
consenting to the practices described in this Privacy Notice.
What Personal Information About Customers Does ART19 Collect?
We collect your personal information in order to provide and continually
improve our products and services.
Here are the types of personal information we collect:

Information You Give Us:
We receive and store any information you provide in relation to ART19
Services, such as your email address, account password, and other
information necessary to create and maintain your account. We also collect
information related to your participation in certain features, such as
surveys in which you choose to participate. You can choose not to provide
certain information, but then you might not be able to take advantage of
certain ART19 Services.

Automatic Information:
We automatically collect and store certain types of information about your
use of ART19 Services, including information about your interaction with
podcasts, products, content, and services available through ART19
Services. Like many websites, we use "cookies" and other unique
identifiers, and we obtain certain types of information when your web
browser or device accesses ART19 Services and other content served by or
on behalf of ART19 on other websites.

Outside of the European Economic Area (“EEA”),
Switzerland or the UK, we might receive information about you from other
sources, such as advertising segments from third-party advertising data
partners.
For What Purposes Does ART19 Use Your Personal Information?
We use your personal information to operate, provide, develop, and improve
ART19 Services that we offer our customers. These purposes include:
- Delivery of ART19 Services.
We use your personal information to facilitate the creation of and secure
your account, to provide podcast services to listeners on behalf of our
customers, to fulfill your requests for certain products and services,
such as enabling you to receive automated reports, and to communicate with
you about promotional offers.
- Provide, troubleshoot, and improve ART19 Services.
We use your personal information to provide functionality, analyze
performance, fix errors, create anonymized and aggregate statistics
regarding the use of Art19 Services, and improve the usability and
effectiveness of ART19 Services.
- Recommendations and personalization.
We use your personal information to recommend ART19 Services that might be
of interest to you, identify your preferences, and personalize your
experience with ART19 Services.

To communicate with you.
We use your personal information to communicate with you regarding
administrative information, such as security or support and maintenance
advisories, to respond to comments and questions, and to otherwise provide
customer support.

Comply with legal obligations.
In certain cases, we collect and use your personal information to comply
with laws. For instance, to comply with applicable tax and other
government regulations or to comply with a court order or binding law
enforcement request.

Advertising.
We use your personal information to provide interest-based ads for ART19
Services that might be of interest to you. We do not use information that
personally identifies you to display interest-based ads. You can opt-out

here. In the EEA, Switzerland or the UK, we only determine relevance
based on your high-level geolocation.
If you are located in the EEA, Switzerland or the UK, we only use your
personal information as described in this section if we have a valid legal
ground for the processing, in particular when:

information, such as understanding the usage of and improving Art19

Your Rights. Subject to applicable law, you have the right to:

What About Cookies and Other Identifiers?
To enable our systems to recognize your browser or device and to provide
and improve ART19 Services, we use cookies and other identifiers. We use
cookies for purposes including:

Recognizing you when you sign-in to use our services. This allows us to
greet you by name, provide you with product recommendations, display
personalized Content, features and ART19 Services.

Keeping track of your specified preferences. This allows us to remember
and honor your account preferences.

Conducting research and diagnostics to improve ART19 Services.

Reporting. This allows us to measure and analyze the performance of our
services. We use third-party analytics providers, including Google
Analytics, to help us understand how users engage with the ART19 Services.
Google Analytics uses first-party cookies to track user interactions,
which helps show how users use ART19 Services. This information is used to
compile reports and to help us improve ART19 Services. The reports
disclose website trends without identifying individual visitors. You can
opt out of Google Analytics without affecting how you use our services by

settings.
Does ART19 Share Your Personal Information?
Information about our customers is an important part of our business, and we
are not in the business of selling our customers' personal information to
others. We share customers' personal information only as described below and
with subsidiaries ART19 LLC controls that either are subject to this Privacy
Notice or follow practices at least as protective as those described in this
Privacy Notice.
- Third-Party service providers:
We employ other companies and individuals to perform functions on our
behalf. For example, outside of the EEA, Switzerland and the UK, we share
your information with third-party advertising service providers, including
those that provide us with advertising segments, help us understand the
effectiveness of ad campaigns, and help us show you ads that we think may
interest you. These third-party service providers have access to personal
information needed to perform their functions, but may not use it for
other purposes.

Business Transfers:
As we continue to develop our business, we might sell or buy other
businesses or services. In such transactions, customer information
generally is one of the transferred business assets but remains subject to
the promises made in any pre-existing Privacy Notice (unless, of course,
the customer consents otherwise). We also reserve the right to transfer
customer information in connection with the consideration, negotiation, or
completion of a merger, acquisition, debt financing, sale of assets, or
similar transaction or in the event of an insolvency, bankruptcy, or
receivership in which information is transferred to one or more third
parties as one of our business assets.

We release account and other personal information when we believe release
is appropriate to comply with the law; enforce or apply our
Conditions of Use
and other agreements; or protect the rights, property, or safety of ART19,
our users, or others. This includes exchanging information with other
companies and organizations for fraud protection and credit risk
reduction.

Information you publicly disclose:
Any information you publish or post to publicly available pages through
ART19 Services may be read, collected, and used by others who access such
pages. Such information can also be seen, accessed, shared, or downloaded
through third-party services such as search engines, APIs, apps, websites,
and other services.

We may also disclose your information with your permission.
How Secure Is Information About Me?
We design our systems with your security and privacy in mind.
- We work to protect the security of your personal information during
transmission by using encryption protocols and software.
- We maintain physical, electronic, and procedural safeguards in
connection with the collection, storage, and disclosure of customer
personal information. Our security procedures mean that we may ask to
verify your identity before we disclose personal information to you.
- It is important for you to protect against unauthorized access to your
password and to your computers, devices, and applications. We recommend
using a unique password for your ART19 account that is not used for other
online accounts. Be sure to sign off when finished using a shared
computer. You are solely responsible for ensuring the security of the
device used to access the ART19 Services.
What About Advertising?

Third-Party Advertisers and Links to Other Websites:
ART19 Services may include third-party advertising and links to other
websites and apps. Third-party advertising partners may collect
information about you when you interact with their content, advertising,
and services. To adjust your advertising preferences, please visit

Use of Third-Party Advertising Services:
We provide ad companies with information that allows them to serve you
with more useful and relevant ads and to measure their effectiveness. We
never share your name or other information that directly identifies you
when we do this. Instead, we use an advertising identifier like a cookie,
a device identifier, or a code derived from applying irreversible
cryptography to other information like an email address. For example, if
you have already downloaded one of our apps, we will share your
advertising identifier and data about that event so that you will not be
served an ad to download the app again. While we do not share your
specific actions like searches with ad companies, we may share an
advertising identifier and an estimate of the value of the ads they show
you on our behalf so they can serve you with more effective ads. Some ad
companies also use this information to serve you relevant ads from other

What Information Can I Access?
You can access your registration data through the “My Profile” section of
our website.
What Choices Do I Have?
If you have any questions as to how we collect and use your personal
information, please contact us as set out in the “Contact Us” section below.
Many of our ART19 Services include settings that provide you with options as
to how your information is used.

As described above, you can choose not to provide certain information, but
then you might not be able to take advantage of certain ART19 Services.

You can add or update certain information through the “My Profile” section
of our website. When you update information, we usually keep a copy of the
prior version for our records.

If you do not want to receive email or other communications from us, you
may follow the unsubscribe instructions contained in the promotional,
marketing, or other similar emails you receive. However, we may still send
you administrative emails when it is necessary to do so. If you don't want
to receive in-app notifications from us, please adjust your notification
settings in the app or device.

You may adjust your personalized advertising preferences and learn more
about how to opt out of personalized advertising (such as interest-based

The Help feature on most browsers and devices will tell you how to prevent
your browser or device from accepting new cookies or other identifiers,
how to have the browser notify you when you receive a new cookie, or how
to block cookies altogether. Because cookies and identifiers allow you to
take advantage of some essential features of ART19 Services, we recommend
that you leave them turned on. For instance, if you block or otherwise
reject our cookies, you will not be able to use ART19 Services that
require you to sign in.

your account, you may do so by signing out of your account and blocking
cookies on your browser.

Cancel or deactivate accounts: If you would like to request the
cancellation or deactivation of your account, you should contact us as set
out in the “Contact Us” section below for assistance. Cancellation or
deactivation of your account does not ensure complete or comprehensive
removal of the content or information you may have posted or otherwise
made available publicly on ART19 Services while you were a registered
user. You should also contact us as set out in the “Contact Us” section
below to request the deactivation of a profile you believe is fake or
otherwise unauthorized.

Published content or pages: We provide you with the ability to unpublish
or modify content located in ART19 Services.
In addition, to the extent required by applicable law, you may have the
right to request access to or delete your personal information. If you wish

Are Children Allowed to Use ART19 Services?
ART19 prohibits registration by children and does not knowingly collect
information or personal information from anyone under 16 years of age. If
you are under the age of 16, you may use ART19 only with the involvement of
a parent or guardian. If you believe that we might have any information or
personal information from a child under 16, please contact us as set out
below.
Additional State-Specific Privacy Disclosures
These additional disclosures are required by the California Privacy Rights
Act, Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer
Privacy Act, and Virginia Consumer Data Protection Act, and serve as a
Notice at Collection under the California Privacy Rights Act:

The personal information that ART19 collects, or has collected from
podcast listeners in the twelve months prior to the effective date of this
Privacy Notice, fall into the following categories established by the
California Privacy Rights Act, depending on which ART19 Services are used:

identifiers such as your name, alias, address, phone numbers, or IP
address;

information that may reveal age, gender, race, sexual orientation, or
other protected classifications;

internet or other electronic network activity information, including
content interaction information, such as content downloads, streams,
and playback details;

geolocation data, such as the general location information based on
your IP address from service providers, which may in some cases
constitute precise geolocation information; and

inference data

Categories of personal information disclosed for a business
purpose.
The personal information that ART19 disclosed to the third parties
identified in the "Does ART19 Share Your Personal Information?" section of
this Privacy Notice about consumers for a business purpose in the twelve
months prior to the effective date of this Privacy Notice falls into the
following categories established by the California Privacy Rights Act:

o Identifiers, including IP address or other similar identifiers,
which we receive from your device when you interact with our ART19
Services;

Geolocation data, specifically, while we do not collect precise
geolocation data from GPS sensors, we do receive general location
information based on your IP address from service providers; and

Internet or other electronic network activity information, which we
receive from your device when you interact with our podcast services,
including information regarding your interaction with our website,
such as your browser type, device type, operating system version and
type, date/time stamps, and listening or other usage information, such
as the number and title of podcasts you’ve listened to, shared, and
skipped.

Advertising.
As explained in the "What about Advertising?" section in our Privacy
Notice, ART19 shares limited information to help ensure you receive more
useful and relevant ads and to measure their effectiveness. Any personal
information ART19 may have shared for the purpose of cross-context
behavioral advertising, as that term is defined by the California Privacy
Rights Act, in the twelve months prior to the effective date of this
Privacy Notice falls into the following categories:

identifiers such as a cookie, a device identifier, or a code derived
from applying irreversible cryptography to other information like an
email address; we never share your name or other information that
directly identifies you.

inference data; while we do not share your specific actions like
views, or searches with ad companies, we may share an advertising
identifier and an estimate of the value of the ads they show you on

The categories of third parties with whom ART19 may share personal
information for the purpose of cross-context behavioral advertising are
identified in the "Does ART19 Share Your Personal Information?" and "What
About Advertising?" sections of this Privacy Notice. ART19 also processes
personal information for the purposes of targeted advertising as that term
is defined under the Virginia Consumer Data Protection Act, Colorado
Privacy Act, Connecticut Data Privacy Act, and Utah Consumer Privacy Act.

Your Data Rights:
You may have certain data rights under state privacy laws, including to
request information about the collection of your personal information by
ART19, to access your personal information in a portable format, and to
correct or delete your personal information. If you wish to do any of

the processing of your personal data for targeted advertising, as defined
by the Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer

your personal information for cross-context behavioral advertising, as
defined by the California Privacy Rights Act. To do so, please visit

(GPC) opt-out signal on your browser, we will honor your opt-out
preference accordingly.
If you disagree with the results of your data request, you can appeal by
emailing us at privacy@art19.com. Depending on your data choices, certain
services may be limited or unavailable. To ensure the security of your
ART19 account, we will generally ask you to verify your request using the
contact information you have already provided. If you do not have an

No sale of personal information:
In the twelve months prior to the effective date of this Privacy Notice,
ART19 has not sold any personal information of consumers, as those terms
are defined under the California Privacy Rights Act.

California Privacy Rights Act Sensitive Personal Information
Disclosure.
The categories of personal information that ART19 collects and discloses
for a business purpose include “sensitive personal information” as defined
under the California Privacy Rights Act. ART19 does not use or disclose
sensitive personal information for any purpose not expressly permitted by
the California Privacy Rights Act.

California Privacy Rights Act and Minnesota Consumer Data Privacy
Act Retention Disclosure.
We keep your personal information to enable your continued use of ART19
Services, for as long as it is required in order to fulfill the relevant
purposes described in this Privacy Notice, as permitted or as may be
required by law, or as otherwise communicated to you.

California Privacy Rights Act Non-discrimination Statement.
ART19 will not discriminate against any consumer for exercising their
rights under the California Privacy Rights Act.

Colorado Privacy Act and Oregon Consumer Privacy Act Profiling
Disclosure.
ART19 does not engage in profiling of consumers in furtherance of
automated decisions that produce legal or similarly significant effects,
as those terms are defined under the Colorado Privacy Act.

California Privacy Rights Act, Colorado Privacy Act, Connecticut
Data Privacy Act, Utah Consumer Privacy Act, and Virginia Consumer Data
Protection Act De-identified Data Disclosure.
ART19 may use de-identified data in some instances. ART19 either maintains
such data without attempting to re-identify it or treats such data as
personal data subject to applicable law.

Oregon Consumer Privacy Act Controller Entity Disclosure.
The controller entities that is subject to the Art19 Privacy Notice and
this Disclosure include ART19 LLC.

New Jersey Notice of Material Change Disclosure.
If we make material changes to our Privacy Notice, we will provide
affected customers with advance notice of the change, such as by email or
via ART19's website.

Annual Reporting for 2024.
Access Requests.
In 2024, ART19 received 1 request from a customer to initiate the data
access process. This request was not fulfilled because the customer did
not complete the verification process. ART19 communicated to the customer
that the access request could not be completed due to failed verification
within 3 days.
Deletion Requests.
In 2024, ART19 received 24 requests from customers to initiate the account
closure and data deletion process. For 5 of these customers, their request
was not fulfilled because the customer did not complete the verification
process. ART19 communicated to these customers that the deletion request
could not be completed due to failed verification within an average of
5days. The remaining 19 requests were processed within an average of 7.3
days.
Correction Requests.
In 2024, ART19 did not receive any requests from ART19 customers to
correct their data.
Cross-Context Behavioral Advertising Opt-Out Requests.
In 2024, ART19 received 74 requests from customers to opt out of
cross-context behavioral advertising. For 23 of these customers, their
request was not fulfilled because the customer did not complete the
verification process. ART19 communicated to these customers that the opt
out request could not be completed due to failed verification within an
average of 8 days. The remaining 51 requests were processed within an
average of 5.8 days.
Conditions of Use, Notices, and Revisions
If you choose to use ART19 Services, your use and any dispute over privacy
is subject to this Notice and our
Conditions of Use, including limitations on damages, resolution of
disputes, and application of the law of the state of California. If you have
any concern about privacy at ART19, please contact us with a thorough
description at
support@art19.com, and we will try to resolve it. Our
business changes constantly, and our Privacy Notice will change also. You
should check our websites frequently to see recent changes. The “last
updated” date at the top of this privacy notice identifies the last date
that the privacy notice was updated. Unless stated otherwise, our current
Privacy Notice applies to all information that we have about you and your
account. We stand behind the promises we make, however, and will never
materially change our policies and practices to make them less protective of
customer information collected in the past without the consent of affected
customers.
Links to Other Websites
ART19 Services may include links to other websites or include embedded video
players (e.g., Vimeo) whose privacy practices may differ from those of
ART19. If you submit information to any of those websites, the privacy
statements and practices of those websites govern their use of your
information. We are not responsible for the content or privacy and security
practices and policies of third-party sites or services to which links or
access are provided through the Services. We encourage you to learn about
third parties’ privacy and security policies before providing them with
information.
